Nationwide Advocacy for Clients Facing Title IX Violations

Any public or private educational institute receiving financial assistance from the Department of Education must comply with a certain federal civil rights law that many people are closely familiar with: Title IX.

Title IX laws apply to nearly all school districts, colleges and universities, as these institutions receive some form of financial assistance through grants and student loans, for example. Unfortunately, Title IX violations are all too common and can result in life-changing damage for victims, therefore it is essential to take legal action.

If your Title IX rights were violated, you must fight for the justice you deserve with the help of our Title IX lawyers at ChancoSchiffer Law, LLC. We are prepared to guide you through the process and diligently advocate for your best interests, as they are at the forefront of everything we do.

What Is Title IX?

Title IX of the Educational Amendments of 1972 states the following:

“No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance"

In other words, Title IX prohibits sex discrimination, which involves mistreating someone because of their sex. Contrary to popular belief, Title IX laws do not only apply to student-athletes but also regular students, faculty, staff, parents and guardians.

Sex discrimination comes in various forms and can occur to men, women and transgender individuals. Examples include:

Sexual harassment

  • Sexual violence
  • Rape
  • Sexual assault, battery, abuse and coercion

Gender-based harassment

  • Slurs
  • Taunts/name-calling
  • Stereotypes
  • Gender-motivated physical threats and attacks

Unlawful retaliation

  • Suspension or termination form a job
  • Getting demoted to a lower employment, academic or athletic position
  • Receiving lower grades for no reason
  • Getting little to no playtime (for student-athletes)
  • Being held to higher, unfair standards than others

How to File a Title IX Complaint

Most schools and universities have their own office or representative that handles Title IX complaints, whether it be the administration, campus life, security or student affairs department, to name some. Before taking legal action, it is best to file a complaint with the proper department and wait for their response.

From our experience, many clients either did not get a response from their school or the school failed to take their concerns seriously by pursuing disciplinary actions against the alleged suspect. If you were not satisfied with your school’s response to your Title IX complaint, then we encourage you to reach out to our nationwide Title IX attorneys at ChancoSchiffer Law, LLC. Our lawyers will hear your side of the story and review your complaint before advising you of an effective plan of action.

Taking Legal Action in Title IX Violations

It is crucial to make your voice heard and fight back against your Title IX violations. Educational institutions have a legal requirement to protect their students, employees and parents from suffering sex discrimination. If your school responded insufficiently to your Title IX complaint, take it to the next level by filing a complaint with the Office for Civil Rights (OCR).

You have 180 days within the date of your alleged violation to file a complaint

  • You have 60 days from the last act you took in the grievance process to file a complaint with the OCR

Gather information needed for the OCR complaint including:

  • Who was discriminated against and in what way
  • The name of the institution who violated your Title IX rights
  • When the alleged act occurred
  • Contact information (yours and the institution’s)
  • Types of disciplinary actions you would like to see taken
  • Additional information to enhance your complaint

Submit your complaint online or by mail

  • The OCR will respond and attempt to remediate the situation or send your case to a civil court to determine the best resolution

You will likely run into obstacles while filing your Title IX complaint wither with your institution or the OCR. Challenges are to be expected, as Title IX procedures often vary from school-to-school. Thus, it is in your best interests to enlist the legal counsel and representation from a proven attorney who genuinely wants to see you succeed.

Our Title IX attorney at ChancoSchiffer Law, LLC will guide you through the process of handling your situation and filing a Title IX complaint. Further, we can explore ways to ensure disciplinary action is taken against the perpetrator while your case is pending with the OCR.
