Georgia Immigration Laws
Though federal lawmakers are constantly creating regulations for immigrants, each state also has a specific set of laws regarding the topic. In 2011, Georgia lawmakers created a strict set of immigration rules that apply to the daily life of state residents, in an effort to regulate the number of illegal immigrants in the state.
Law Enforcement and Immigration
Almost every aspect of immigration law is controversial but one of the most controversial aspects regards law enforcement and immigration. Georgia law requires police officers to check the immigration status of any person who cannot provide identification when the police ask for it. One of the only situations that is an exception to the law is if the person is the victim of or witness to a crime. A law enforcement officer does not have to check his or her immigration status then, even if he or she cannot provide identification.
A federal program called “Secure Communities” requires law enforcement officials to take the fingerprints of all people they arrest and check them with an immigration status database.
Under Georgia law, it’s illegal to try to get a job with fake identification documents. If law enforcement discovers that you obtained a job (or tried to) with fake documents, the charges against you could include prison time and fines.
In an effort to discourage people from using fake identification documents, lawmakers now require all employers to use the E-Verify check system for new workers, which verifies if an employee has authorization to work.
Driver’s License and ID Requirements
If someone attempts to get a driver’s license, he or she must provide proof of identity, residency in the state, and citizenship or lawful residence in the United States. If you do not have the necessary documentation, you could face serious fines and charges if a police officer pulls you over.
Public Benefits Restrictions
Federal law prohibits illegal immigrants from receiving public benefits. Georgia law requires people trying to get benefits to provide identification; exceptions include emergency services, health care, and any other programs that federal law considers necessary for overall health and safety.
Voter ID Rules
Though many states have regulations regarding voter restrictions for immigrants, Georgia’s rules are some of the most intense. Everyone must provide a photo ID at the voting booth. If a person cannot provide a photo ID, he or she can fill out a provisional ballot but must show a photo ID at the county registrar’s office within three days of the election.
